on basketball players to make sure they don't trash talk on the court. "fox & friends" starts now. >>steve: we're like carmelo anthony right now because people have microphones on us to hear what we're going to say. >>eric: make sure we don't do trash talking during the breaks. crazy. >>gretchen: i don't know if it's crazy or not. i guess we'll debate it. it all stems from carmelo anthony and kevin garnett when they got into it. maybe this is a way to try to curb some of that trash talking which is essential if you're a basketball player. i understand. it's an essential part of the game nobody talks about. >>eric: when you start calling somebody's wife a serial, you have crossed the line to say it. >>gretchen: let's talk about politics because there is no trash talking in politics. we all know that; right? back in september of 2006, i think it was, president obama -- and 2008, by the way -- when he was a senator, he talked a lot about the debt ceiling. remember, president bush was in office at the time, so senator obama would probably be against some of the things he was talking about, particu

to steve. >> a beautiful sunrise here. a few high clouds. i know it's cold. man, it hurts. hurts. temperatures in the 20s. more 20s than yesterday. it doesn't happen if you are inland. it can help downslope, the offshore breeze will help the bay. frost and freeze warnings are out. those higher clouds coming down out of the north. northeast. so that's the direction the wind is coming from. that's what gives us a little bit of that high cloud cover. there's actually some warm temperatures up in alaska. there's more of this in arizona and nevada. yesterday, there was a lot more of a breeze. when the wind is calm, the temperature drops down. that's what you are getting. fairfield, 26. brentwood, 29. concord, 29. walnut creek, 28. livermore/pleasanton, upper 20s. santa rosa, 28. napa, 28. 38 half moon bay. not far away i've seen 32. redwood city says 35. san jose, 33. campbell, santa clara, upper 20s. woodside also upper 20s and there is a bunch in the mountains. you need more cloud cover and kind of a west wind. we're not getting that. it will stay cold but that helps areas around oa

it. so we've soeen it before. >> and i agree with steve on that, he has the audacity to disagree with me somewhat. i actually think the republicans looked at the fiscal cliff, they passed the senate bill, said it is up to you. they basically blinked and said we don't want to go over the cliff. so they know they don't really have it will them to want to default on the debt ceiling. the landscape is different from 2011, yes, they're still nutty and responding to that calculus. i don't think they're quite as credible in terms of actually causing a default. and take what? social security and medicare benefit cuts, that is tremendously unpopular, it would be a disaster. but also a catastrophe for the republican party. >> and this comes at a moment where they're being criticized from kind of all sides. i want to listen to something colin powell said yesterday about their identity problem. >> i think the republican party right now is having an identity problem. and i am still a republican. i think what the republican party needs to do right now, take a hard look at itself. the country i

of the president's second term agenda will be easy with the republicans in congress. take texas congressman steve stockman. he replaced ron paul and is making noise about impeaching the president. it's his second go around in congress. in '94 he was considered far to the right. now he fits in with some of these people. it says a lot how far they have come. >>> finally let me finish with a need for republicans again to choose sides. the wild bunch or the posse? this is "hardball," the place for politics. [ man ] ring ring... progresso this reduced sodium soup says it may help lower cholesterol, how does it work? you just have to eat it as part of your heart healthy diet. step 1. eat the soup. all those veggies and beans, that's what may help lower your cholesterol and -- well that's easy [ male announcer ] progresso. you gotta taste this soup. >>> coming up monday, president obama will deliver his second inaugural address as president. four years ago in his first address, the president paid tribute to the historic nature of his election. >> this is the meaning of our liberty and our creed why men

point out how hard this is going to be to get through congress. but representative steve stockton of texas appeared on fox news talking about impeachment if the president tries to push this forward. take a listen. >> we want all tools available to use, including that impeachment. using children reminds me of saddam hussein when he used kids. >> alice, i want to get your reaction to this. we have had presidents in the past use executive orders to push through gun control legislation, whether it was bush 41 or bill clinton. no one then talked about impeachment for those presidencies. why does the right have to go to such language based on the fact that we're looking at a massacre at an elementary school? how come the right doesn't want to talk logically about what can be done? >> well, i think that language is a little harsh but the truth is there's a reason why the president's going to be flanked with small children at his press conference today, as he begins his p.r. campaign, and why he's talking about using executive action on this issue when it comes to gun control, because he

. and to underscore that point, which i think does get to what steve said a little earlier, and that is, obviously -- you can have a discussion, and you can have a set of of policies, but we're going to be as good as our national congress setting a floor with legislation. and if california wands to exceed it for whatever or reason, they'll go farther. but the national discussion, and i think the it's one of the priorities in the discussion tomorrow and i think you can get bipartisanship on it. when the background checks were set up because of of what happens at gun shows and everything else, 40% of the guns that are traded or bought are not covered with any background five-day waiting period. that's not a loophole, that's an exemption. and that has to be dealt with so you create a national floor that's comprehensive so what happens in indiana doesn't flood the city of chicago, cook county. and it's essential to underscore that point. >> if i could, it needs to be a national be fix, and it has to be federal preemption because the patchwork of states or cities working by themselves is not effective.

>> steve: you keep sending pictures of your furry friends, so we're going to show you when it's not so furry, it's fifi the iguana. look at that. a fan of "fox & friends." >> gretchen: oh, my gosh. >> steve: very nice. keep them coming. >> gretchen: dr. ian will stick around for the after the show show. around congress and enact new gun laws with executive order. vice president biden telling house democrats at least 19 of those actions are being prepped and will be implemented whether congress likes it are not. leads to the question, what are they. i'm bill hemmer. happy tuesday on america's news room. martha: i'm martha maccallum. these orders are more aggressive of current laws which a lot of people said is really the first place to start, or, they will try to get the centers for disease control to do some national research on firearms. bill: on the other side many argue, democrats and republican lawmakers, you need to look at more than just guns. >> this is a very important constitutional right and we are very dedicated to protecting the second amendment from that standpoin

broadly written and ambiguousus that prosecutors, like steve heineman, who just want, as i said earlier, just won a notch on their belts, can throw the book or to charge someone with 35 years in prison for miley and considered behavior -- mildly consideand consider behavior. why does someone like steve heineman have the power to do this, unbridled power? why would you charge someone with up to 35 years in prison if he actually think all the desert is six months as the plea deal suggested? this happens to people every day and must have your resources than aaron and much less support, and don't have the option necessarily of even considering hiring a lawyer and going to try all over the course of two years and are forced to take the plea deals when they're not guilty or the plea deals are completely unjust. when a broad criminal justice reform in this country. we incarcerate more people per capita than any other country in the world. we do not have lower crime rates because of it. there is justice and there is justice. right now our system does not promote justice. our system is punitive.

quick here. if you're a fan of comedy, you have to love steve harvey. a great new talk show on doing well and he just had a show celebrating his 56th birthday. as part of that show, they had a man call in who was instrumental in his early career when he was -- 30 years ago as a struggling carpet cleaner in florida. this guy and his wife gave him the money to launch steve's career. take a look at what happened when the guy called in to steve's show. >> i was 26 years old, man. i was struggling. i didn't have nothing, and these people owned a furniture store, and man, i ran up a bill like $11,000 just trying to travel and make it. and they helped me out. hey, man, i got money now, rich. >> everyone starts somewhere and never forget the people that helped get you where you are. really cool to see that. >> the good people never forget where they came from. >> amen. >>> britney spears, you know she and jason broke up last week and she broke up with the "x factor" and now has a huge deal in las vegas. well, she was seen without her engagement ring on monday, replacing that $90,000 ring wit

his gun safety measures. texas rep steve stockman issued the warning yesterday saying he will introduce articles of impeachment if obama uses executive order to keep guns out of the hands of criminals. stockman claims a use of that power by the president would be unconstitutional and an existential threat to the nation. this is not the first time he's taken a controversial stance on guns. during his first term in the house, his office was slow to turn over a letter to the fbi that appeared to contain evidence about the oklahoma city bombings. last week, he proposed a repeal of all gun-free zones in schools. it looks like president obama might have to issue executive order if he wants anything done on gun control. joe biden's task force will likely propose a ban on high-capacity clips and on assault weapons but majority leader harry reid says something like that might pass the senate but he doubts it has any chance of passing the house. state governors though are making some progress on new gun laws. new york's andrew cuomo and other lawmakers from the state reached a deal

the first cell phone. this might have been the first smartphone. but when steve jobs said the following, he started the real smartphone revolution. listen. >> this is one device. and we are calling it iphone. >> we're calling it iphone. back then, people used blackberries, then they started switching over to iphones. i bet you don't know who these two guys are. you would have if you were me, because i've come from canada. these are two canadians, these are the guys from canada who started research in motion, the company that makes the blackberry. what they didn't do, they did a lot of things right, but when they first saw this iphone they looked at it and said, nah, i don't think it will be that big a deal. that was not the right thing for them to do. let's talk about iphone versus blackberry sales. the iphone came out in 2007. the blue line is blackberry sales. the red line is iphone sales. see they sort of trended together for a while and then in 2010, apple started doing interesting things and started doing that with its sales. look what happened to blackberry. that's where we are today.

was like an aide to bob dole. steve stockman who got the extra dose of crazy as a member congress, he will introduce an impeachment resolution. and the nra will fund raise off of that. this is the thing. there has been a been a good amount of writing by david fromme about the right-wing as a racket, as an operation they don't care whether they win or lose. they like to take on crazy issues that can get 10, 15% of the people to give them money whether the nra continue to choose to be a racket, go for the money or choose to try to remain age organization of gun owners. if they don't, i think they will get beat again and again and again, state after state because they are so far from the mainstream. >> talking down their own site. that was the great joy of this past election day was the morning after the democrats swept most of the the races in country, you know the cokekoch brothers and sheldon adelson that karl rove and the rnc had redistributed their wealth. >> that's what they do jon fugelsang with stephanie miller's sexy liberal comedy tour. good l

and utter a threat of impeachment against president obama. steve stockman, republican of texas, over the gun issue, said, i will file an impeachment resolution against him. so it really is much the same. there's an oppositional, almost insurgent republican party and democrats who have been sometimes naive about what the opposition really feels, what they're really ready to do, especially the sort of core, hard-core wing of the republican party. >> hey, peter, robert gibbs was just on with us, and it's something you just mentioned. the level of exhaustion within the white house, of the people re-interviewed, that you went back to this year, four years later, how many of them mentioned the exhaustion factors as a component part of what happens to them? >> oh, sure, all of them, basically, i think, suffered it from some way or another. melody barnes, you just had on your program, talked about sleeping with her blackberry and waking up with a start at 3:00 in the morning, suddenly, you know, trying to think about something she hadn't done or worrying about some crisis that was going to happen. c
